By content, in the sense of these terms and conditions, the following shall be understood:

• information related to the products, services and/or rates charged by VOCALZONE.RO in a certain period;
• information related to the products, services and/or rates charged by a third party with whom VOCALZONE.RO has concluded partnership contracts, during a certain period;

CAMPAIGN - the act of exhibiting for commercial purposes, exclusively electronically and only through the website, a finite number of products with a limited and predefined stock, for a limited period of time established by VOCALZONE.RO.
SERVICE - e-commerce service, in the sense of giving the CLIENT the possibility to contract products and/or services using exclusively electronic means.
MEMBER - The natural person who obtains access to the CONTENT, through any means of communication made available by VOCALZONE.RO (electronic, telephone, etc.), based on a user agreement existing between VOCALZONE.RO and it and which requires the creation and use an ACCOUNT.
ACCOUNT - the set consisting of an e-mail address and a password that allow a single MEMBER access to restricted areas of the SITE through which access to the SERVICE/contracting is made.
CLIENT - The natural person who is a VOCALZONE.RO MEMBER and/or the person who has placed at least one order on the site.
DOCUMENT - these Terms and Conditions
CONTRACT at a distance - according to the definition contained in O.G. 34/2014 any contract concluded between the professional and the consumer within an organized distance sales or service provision system, without the simultaneous physical presence of the professional and the consumer, with the exclusive use of one or more means of distance communication, up to and including the moment when the contract is concluded;
NEWSLETTER / ALERT - periodical means of information, exclusively electronic, respectively electronic mail (e-mail, SMS), on the products, services and/or promotions carried out by VOCALZONE.RO in a certain period, without any commitment from VOCALZONE .RO with reference to the information contained therein.
TRANSACTION - collection or reimbursement of an amount resulting from the sale or promise of sale of a product / service by VOCALZONE.RO to the Client, by using the services of the card processor approved by VOCALZONE.RO, regardless of the method of delivery;

The name VOCALZONE.RO, VOCALZONE.RO and the VOCALZONE.RO logo are trademarks registered by Alanmas SRL. The reproduction, imitation, use or application of these brands without obtaining prior authorization from Alanmas SRL is a crime punishable according to the laws in force.

The entire content of the VOCALZONE.RO website - images, texts, graphics, symbols, graphic elements, scripts, programs and other data - is the property of VOCALZONE.RO and its suppliers and is protected by the Copyright Law and the laws regarding intellectual and industrial property. EMAIL MARKETING AND ALERTS
When the Member or Customer creates an Account on the Site, accepts the Document (Terms and Conditions) and ticks the option to Subscribe to the Newsletter or SMS Alert, it will be considered that he has expressed his agreement regarding the receipt of newsletters and/ or alerts from VOCALZONE.RO, sent by electronic mail (e-mail). The option regarding the agreement issued by the Client or Member can be modified at any time, in compliance with the provisions of art. 5.3.
Data collected from a Member or Client, for the purpose of sending newsletters and/or alerts, can and will be used by VOCALZONE.RO within the limits of the Privacy Policy.
Opting out of receiving newsletters and/or alerts by the Member or Client can be done at any time by the request sent to VOCALZONE.RO, by the Member or Client belonging to the Member or Client account to which the modification/update is being made;
Law no. 506 of 2004, regarding the implementation of the ePrivacy Directive in Romania, allows companies like VOCALZONE.RO, which have customers who have purchased products or services, to send these customers commercial communications similar to those they have already purchased. In that case, the CLIENT's consent is not needed, but the mention of the client's right to object to the sending of these commercial communications.
Opting out of receiving newsletters and/or alerts does not imply waiving the acceptance given for the Terms and Conditions document.

PRIVACY POLICY OF PERSONAL DATA
This Policy establishes VOCALZONE.RO's policy regarding:

What is a data subject?
For the purpose of this Policy, a "data subject" is a living person about whom VOCALZONE.RO processes personal data. All data subjects have rights over their personal data.

• solving cancellations or problems of any kind related to an order or a contract, to the services or products purchased by him;

• contacting him, at his voluntary request;
• contacting him, in matters of Customer Relations;
By creating the Account, each Member or Client expressed their consent for VOCALZONE.RO to collect and administer their personal data, under the conditions and in compliance with the provisions of Law 677/2001.
Any Member or Client has the right to obtain from VOCALZONE.RO, through a written, signed and dated request, free of charge:
1. confirmation of the fact that the data concerning him are or are not processed by him
2. as the case may be, rectifying, updating, blocking or deleting data whose processing is not in accordance with the law, especially incomplete or inaccurate data;
3. as the case may be, the transformation into anonymous data of data whose processing is not in accordance with the law;
4. notification to third parties to whom the data of any operation carried out according to letter b) or c), if this notification does not prove impossible or does not involve an effort disproportionate to the legitimate interest that could be harmed.
By virtue of voluntary registration on the VOCALZONE.RO website or accessing (ordering) VOCALZONE.RO products/services, the Member or Client agrees with (consents to) the processing of personal data by VOCALZONE.RO in its own system computer, both manually and automatically, for the purposes stated in point 6.1, in accordance with art. 5 paragraph 1 of Law no. 677/2001 regarding the protection and processing of personal data. If the Member or Customer does not agree with the processing of his personal data by VOCALZONE.RO, he has the right not to use the website and not to provide VOCALZONE.RO with personal data.
Any Member or Client has the right to object at any time, for well-founded and legitimate reasons related to his particular situation, by submitting to VOCALZONE.RO a request drawn up in writing, dated and signed as data that aims to be the object processing, except in cases where there are legal provisions to the contrary. In case of justified opposition, the processing can no longer concern the data in question.
Any Member or Client has the right to object at any time, free of charge and without any justification, by sending to VOCALZONE.RO a written request, dated and signed, that the data concerning it be processed for the purpose of direct marketing, on behalf of the operator or a third party, or to be disclosed to third parties for such a purpose.
The customer has the right to object to the collection of his personal data and to request their deletion, thus revoking his consent given for the document, and thus renouncing any implicit right specified in it and without any subsequent obligation of any party to the other or without so that one party can claim damages from the other.
To exercise the rights according to art. 6.2, the Client or the Member will address VOCALZONE.RO, by any means of written communication.
If the Customer opts for online payment of the order value, VISA and MasterCard cards, issued by banking institutions, are accepted, provided that the issuing banks have activated them for online payment.
VOCALZONE.RO does not request or store any information related to the Customer's bank card or cards, these being processed directly on the servers of the online payment service provider.
The VOCALZONE.RO privacy policy refers only to the data provided voluntarily by the Customer or Member exclusively on the site. VOCALZONE.RO is not responsible for the policy of confidentiality practiced by any other third party that can be reached through links, regardless of their nature, outside the site.
VOCALZONE.RO undertakes to use the collected data of the Client/Member only in accordance with the stated purposes and not to publish, sell, rent, license, transfer, etc. the database containing information relating to the personal or special data of the Member/Client of any third party not involved in the fulfillment of the declared purposes.
Exception from the provisions of art. 6.7 will make the situation in which the transfer / accessing / viewing / etc. is required by the competent bodies in the cases provided by the regulations in force on the date of the occurrence of the event.
The bank card processor(s) approved by VOCALZONE.RO have the right to access/view any type of data/documents, generated following an order issued, canceled order, contract, canceled contract or a contract honored, to investigate any Transaction, if it exists.
VOCALZONE.RO guarantees that the personal data of a customer/user/member, collected through the contact form, will be used only until the problem communicated by him is resolved, after which they will become exclusively statistical data.
VOCALZONE.RO is not responsible for failures that may endanger the security of the server on which the database containing this personal data is hosted.

The customer account is created automatically when the order is completed, the account created can be canceled at any time by the request sent to VOCALZONE.RO, by the customer belonging to the account to which the modification/update is being operated;
• In order to be allowed access to the service, the Client will have to accept the Terms and Conditions that regulate the legal relationship between VOCALZONE.RO and the client/member
• VOCALZONE.RO reserves the right to restrict or exclude the Client's access to the Service, and/or to some of the accepted payment methods and to delete or restrict his Account, within the limits of the law, if he considers that based on his conduct or of the Client's activity on the site, access and the existence of his Account could harm or harm VOCALZONE.RO in any way. The customer can address, in writing, the Customer Relations Department of the company, to be informed about this
re to the reasons that led to the application of the mentioned measures.
• Each Member can have only one Account. It is forbidden to share an Account between several Members/Clients.
Products, services and prices
• VOCALZONE.RO can publish on the website information about products, services and/or promotions practiced by it or by any other third party with which VOCALZONE.RO has concluded partnership contracts, during a certain period and within the limit of available stock.
• The products and/or services purchased through the service are intended exclusively for the Client's personal use.
• VOCALZONE.RO can limit one or more Customers, the ability to purchase some products or services available on the site at a given time, under the conditions of art. 7.1.
• All prices related to the products or services presented on the website are expressed in RON (RON) and include VAT.
• The invoicing of the purchased products will be issued exclusively in LEI. If the payment is made by bank card, VOCALZONE.RO will debit the Customer's current account with the amounts representing the value of the ordered products, after sending the order confirmation to the latter.
• In the case of online payments, VOCALZONE.RO is not/cannot be held responsible for any other additional costs borne by the Customer, including but not limited to currency conversion fees applied by the card issuing bank, if the currency of its issue differs from the national currency. The responsibility for this action is borne by the Client alone.
• All the information used to describe the products and/or services available on the site (static / dynamic images / multimedia presentations / etc.) do not represent a contractual obligation on the part of VOCALZONE.RO, they are used exclusively for presentation purposes.
• In the description of the products and/or services, VOCALZONE.RO reserves the right to use other products (accessories / etc.) that may not be included in the costs of the respective products.
Despite the efforts of VOCALZONE.RO, considering the large number of products on the site, some products may have incorrect prices, displayed erroneously or may represent human errors. Under these conditions, the price accepted by VOCALZONE.RO after generating the invoice is always considered as the final price. Except for the situation in which, following a conversation with the Client, another resolution is reached. For any such problem, VOCALZONE.RO will notify the Client through any of the contact methods provided by him.
For products with "in stock supplier", VOCALZONE.RO cannot guarantee the price. Availability is displayed in real time. Availability may change at any time during order processing.
Online order
• The customer can place an order on the VOCALZONE.RO website only after creating an account. The customer can cancel the created account at any time, communicating this via email to OFFICE@VOCALZONE.RO.
• The customer can place orders for products sold at a given time, exclusively on the website, by adding the desired product/products to the shopping cart, then completing the order by paying through one of the expressly indicated methods. Once added to the shopping cart, a product is available for purchase as long as it is in stock. Adding a product to the shopping cart, without completing the order, does not entail the automatic reservation of that product.
• By completing the order, the Customer agrees that all the data provided by him, necessary for the purchase process, are correct, complete and true on the date of placing the order, named in this document and the order issued.
• By completing the order, the Client agrees that VOCALZONE.RO can contact him, by any means available / agreed by VOCALZONE.RO and provided for in this Document, in any situation in which it is necessary to contact the Client.
• VOCALZONE.RO can unilaterally denounce the order made by the Client, following a prior notification addressed to the Client, without any subsequent obligation of either party to the other or without any party being able to claim damages from the other in the following cases:
o non-acceptance by the issuing bank of the Client's card, of the transaction, in the case of online payments;
o invalidation of the transaction by the card processor approved by VOCALZONE.RO, in the case of online payment;
o the data provided by the Customer on the website are incomplete or incorrect;
a Client's activity on the website can and/or causes damages of any kind, or damages VOCALZONE.RO and/or its partners in any way;
making more than one consecutive failed delivery attempt;
• The customer can cancel an order
• If the Client renounces within the legal term of withdrawal from the contract, a coma
not made, for which the payment was made by bank card and in which the bank issuing the Client's card transferred the amounts paid to the VOCALZONE.RO account, this amount will be returned by VOCALZONE.RO within a maximum of 14 calendar days from the date on which the latter took note of this fact, in the IBAN account indicated in writing by the Client.
• In the event that a product ordered by the Customer, having previously paid by bank card, cannot be delivered by VOCALZONE.RO, due to its own fault or the fault of a third party, VOCALZONE.RO will inform the customer of this fact and submit all the legal due diligence for the recovery of the amount and its return to the Client's account, within 14 working days from the recovery of this amount, if recovery is required.
• The customer does not have the right to change the content of an order after it has been prepared or shipped.
• Product delivery details, including but not limited to the time required for delivery, do not constitute a contractual obligation on the part of VOCALZONE.RO, without any party being able to claim damages from the other, in the event that any party may be or is prejudiced in any way following their violation.
• If a Customer modifies his personal data, using the forms available on the website, all existing orders in progress at that time keep the data defined/accepted by the Customer after the moment of making the change, being taken into account for delivery and contact, the new data modified accordingly.
• The order represents VOCALZONE.RO's purchase offer. Note that the order registration email (the first email you receive after completing the order on the website) should not be considered the final acceptance of your order by VOCALZONE.RO
Acceptance of your order is done when we notify you by e-mail that we have shipped the product/products and generated and sent the invoice in electronic format.
The availability of a Product will be displayed on VOCALZONE.RO as follows:
• "in stock" - products that are physically in the VOCALZONE.RO warehouse
• "unavailable product" – The product is not available in the VOCALZONE.RO stock.

• the customer has the possibility to place telephone orders
Delivery of orders
• The delivery of the purchased products/services to the Customer is carried out by means of a fast courier company. The fast courier company processes personal data of the VOCALZONE.RO Client, exclusively for the provision of transport services for the products purchased by them from the company's website and only in full compliance with the present VOCALZONE.RO Terms and Conditions document. Also, the third-party partners of the fast courier company, mandated for the fulfillment of transport services, which process personal data of VOCALZONE.RO Customers, are required to strictly comply with the terms and conditions of the law regarding the safety of personal data processing and of this VOCALZONE.RO Terms and Conditions document. In this sense, the fast courier company can contact VOCALZONE.RO Customers by any means of communication (e-mail, telephone, SMS) within the limits and for the purpose provided for in this article.
• Deliveries will be made, on average, in 1-2 working days from placing the order, when ALL ordered products are available "in stock", and in 1-5 working days for orders in which at least 1 product out of 1 ordered is "in supplier stock". In the event that the product will be delivered after the above-mentioned deadline, VOCALZONE.RO will inform the Customer by E-mail or Telephone within 7 days of placing the order, and the Customer may cancel the order, without having the right to request damages interests
VOCALZONE.RO delivers to any town in Romania, but also internationally, in countries that are part of the European Union.
Delivery estimates are based on the intervals communicated by the collaborating courier companies, but VOCALZONE.RO cannot guarantee a term or delivery interval. VOCALZONE.RO will always try to notify the customer when there is a possibility of a delivery delay, either through a message in the website header, or through telephone contact or email.
Orders with national delivery are sent via DPD, FAN COURIER and SAMEDAY courier companies
International orders are shipped SAMEDAY.
The international delivery fee shown when selecting any country except Romania is ONLY valid for parcels that do not exceed 2kg, including product packaging and protective packaging added by VOCALZONE.RO. ALL parcels with international delivery will be weighed, and if they exceed 2kg or the volumetric size agreed for the displayed cost, a VOCALZONE.RO operator will contact the customer by email or by phone and will inform him of the final fee. The customer will receive by email a payment link to pay the price difference. If the price difference is not paid, VOCALZONE.RO reserves the right to cancel the order and return the full amount paid for the order placed.
Refusal to receive the package and return the products
• The VOCALZONE.RO customer can refuse to receive the parcel containing the products purchased through a Contract, or, as the case may be, can return the products, in the following situations:
o The package has severe damage;
o The products were delivered / invoiced incorrectly;
o The products have manufacturing defects;
o The products do not correspond to the description;
The customer has the right to notify VOCALZONE.RO in writing that he is canceling the purchase, respecting the term of 14 calendar days from receiving the product according to the provisions of OG 34/2014 and on the condition that the parcel is not unsealed.
Considering that the products sold by VOCALZONE.RO are products that are exempt from the right of withdrawal, according to art. 16 of OG 34/2014, since they are perishable products and cannot be returned for reasons of health protection or for reasons of hygiene, the Customer is no longer entitled to return unless, after unsealing the package, he will find other products other than those ordered.
• The customer undertakes to notify VOCALZONE.RO of his intention to return the purchased products, by any means of written communication (e-mail/fax/etc) within a maximum of 14 calendar days from the receipt of the products and/or services.
• The customer who notified VOCALZONE.RO is responsible for ensuring that the products he referred to will be returned within a maximum of 14 calendar days, otherwise, VOCALZONE.RO, considering the request unfounded/invalid, may refuse the return.
• In case of reimbursement of the product value, this will be done within 14 calendar days at most from the confirmation of the return, and the reimbursement will be made only to the customer's bank account, regardless of the payment method from the placed order.
• In the case of product replacement, the replacement will be done under the conditions and limits of a normal order.
• The value of the additional services, including but not limited to the transport of the products, paid by the customer, is not reimbursed.
• In all cases, the return/re-shipment costs will be borne by the customer, except for the situations presented above, as well as in the case of non-compliance, in which case VOCALZONE.RO will bear the cost of the transport.
• Products purchased as a package are accepted for return only in their original form, that is, all products contained in the returned package must be intact, sealed.
Products for which returns are not accepted are:
• Unsealed products.
• Damaged products
The validity period of the products
1. All products sold by VOCALZONE.RO have a long shelf life, depending on the specifics of each product (food, cosmetic, beekeeping, etc.)
2. If the validity period is short, it will be clearly specified in the product description
3. If the customer is not satisfied with the validity period of the products received, he can make a return
Parcel returned without prior notice
In the event that a package that was sent by VOCALZONE.RO is not accepted by the recipient without a given reason and without prior notification by any means of contact: telephone, email, chat support, etc. the following measures will be ordered:
• in the customer account associated with the returned order, only the online card payment method will remain active for the following orders placed.

Any conflict arising between Alanmas SRL and customers is tried to be resolved amicably by understanding between the two parties. Alanmas SRL undertakes to return to the customer the sums collected for the returned products, within a maximum of 14 calendar days from the date of termination of the contract by you.
If amicable conciliation is not possible, the Romanian legal provisions in this field will be applied, and the resolution of conflicts is the competence of the Romanian courts.

Review – an evaluation written by the owner or beneficiary of a product or service, written evaluation based on personal experience and his ability to make qualitative comments and to say whether or not the product complies with the specifications mentioned by the manufacturer and whether he is satisfied or not with its purchase.
Reviews on the VOCALZONE.RO website can be of 2 types
• 1. Review from a VOCALZONE.RO customer who bought the product from the VOCALZONE.RO website, in this case the respective comment/opinion is marked on the website as Verified Purchase
• 2. Review published by a user of the VOCALZONE.RO website who did not purchase the product through the VOCALZONE.RO website (or VOCALZONE.RO has no information about this purchase) but who knows/used the product and wants to to publish an opinion. In this case the comment will be published but will not be marked as Verified Purchase
Reviews are published on the website in chronological order, regardless of the customer's note or comment.
- Writing Reviews, Comments, Questions and Answers can be done, by Users/Clients/Buyers, in the dedicated sections of the product page or through the forms received by email. The written information can be both positive and negative, and will only refer to the characteristics and how to use a product or service.
- At the time of recording a certain Review/Comment/Question/Answer on the Site, Users/Clients/Buyers grant the owner of VOCALZONE.RO a non-exclusive, perpetual, irrevocable, territorially unlimited license and give the owner the right to use, reproduce, modify, adapt, publish, translate, distribute and display this content.
- Each User/Client/Buyer, when registering a Review/Comment/Question/Answer in the mentioned sections, undertakes to comply with the following rules:
- to refer only to the characteristics and/or the way of use of a certain product or service, avoiding information related to commercial aspects that can change (price or promotional offers) or information related to the way the order is carried out;
- to use appropriate, non-offensive language, without terms that may offend or affect any other User/Client/Buyer;

In addition to a realistic evaluation of the product, when writing a Review, the User/Client/Buyer will also add a Note/Rating relevant to the product. The reviews, together with their corresponding Ratings, will influence the general Rating of the product, a number that appears in parentheses next to their title. Thus, a Review accompanied by a high Rating leads to an increase in the General Rating, and a Review accompanied by a low Rating leads to a decrease in the General Rating.
Users/Clients/Buyers who write Reviews to which they attach photo files will comply with the following rules:
– the uploaded files will contain images that refer to the product or service for which the Review is written, ensuring that the uploaded files respect copyright;

If the Seller finds repeated violations of the Terms and Conditions, it reserves the right to suspend the possibility of the User/Client/Buyer to write Reviews/Comments in the sections of the website.

The maximum term for resolving complaints or notifications is 30 calendar days from their receipt.

FORCE MAJEURE AND FORTUNE
Except for the cases in which they have not expressly provided otherwise, none of the parties to a concluded contract, which is still in progress, will be responsible for the non-execution on time and/or in an appropriate manner, in whole or in part, of any of the obligations that it is incumbent on him based on the contract, if the non-execution of the respective obligation was caused by a force majeure event.
The party or the legal representative of the party that invokes the event mentioned above, will immediately and fully inform the other party of its occurrence and take any measures available to limit the consequences of that event.
The party or the legal representative of the party that invokes the event mentioned above is exempted from this obligation only if the event prevents it from completing it.
If within 14 days from the date of its occurrence, the said event does not cease, each party will have the right to notify the other party of the termination of this contract without any of them being able to claim damages to the other.
The party invoking the force majeure event must prove the impossibility of fulfilling the obligations within 30 days from the date of occurrence of the event, but within the above limits.

By using/visiting/viewing/etc the sites and/or any content sent by VOCALZONE.RO to the Member/Client by accessing and/or sending by any means (electronic, telephone, etc), he/she declares to agree at least with the provisions "Terms and conditions".
Any dispute with reference to these Terms and Conditions that could arise between the Member/Client and VOCALZONE.RO will be resolved through
amicably, the parties submitting all the necessary diligence in this regard.
Any dispute, of any kind, that could arise between the Member and VOCALZONE.RO or its partners, will be resolved amicably. If this is not possible, the conflict will be resolved by the competent court at the VOCALZONE.RO headquarters, in accordance with the Romanian laws in force.
If any of the above clauses is found to be void or invalid, regardless of the cause, this clause will not affect the validity of the other clauses.
This document has been drafted and will be interpreted in accordance with Romanian legislation.

GUARANTEE OF CONFORMITY
Alanmas SRL has the obligation to deliver products that are in accordance with the sales contract, regardless of the form in which it is concluded, verbal or written.
The products sold on the website www.VOCALZONE.RO benefit from a guarantee according to art. 4 - point 1 lit. e from GEO 34/2014 and art. 5-18 of Law no. 449/2003, if they are not perishable products.
All products sold by VOCALZONE.RO benefit from warranty conditions in accordance with current legislation and commercial policies. The products are new and come from sources authorized by each individual manufacturer.
VOCALZONE.RO undertakes to cover the guarantee of conformity according to the law, within 2 years, calculated from the delivery of the product. In the first 6 months after the purchase, the consumer does not have to prove the non-conformity, it is considered that it existed on the date of purchase. For the period from 6 months to 2 years, the lack of conformity will have to be proven by the consumer. I make an exception for products whose average duration of use is less than 2 years, in which case the warranty period is reduced to this duration.

FINAL PROVISIONS
VOCALZONE.RO reserves the right to make any changes to these provisions, as well as any changes to the site/its structure/service as well as any content with the prior notification of the Member or the Client, who will then express his agreement to the changes , in at most 3 days. If the client/member does not express his agreement/disagreement with the changes, within the 3-day period, it will be interpreted that he has tacitly expressed his agreement with all the changes made to these terms and conditions.
Within the limits of the Terms and Conditions, VOCALZONE.RO cannot be held responsible for any errors that may appear on the site for any reason, including changes, settings, etc., which are not made by the site administrator.
VOCALZONE.RO reserves the right to insert advertising banners of any nature and/or links on any page of the site, in compliance with the legislation in force.
